Welcome to FoodRank. These Terms of Service (“Terms”) are a binding agreement between you and FoodRank (“FoodRank,” “we,” “us,” or “our”) and govern your access to and use of the FoodRank website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
Authentication is handled by our identity provider, Clerk. You are responsible for the activity that occurs under your account and for keeping your credentials secure. Notify us promptly at support@foodrnk.com if you believe your account has been compromised.
FoodRank lets you vote for restaurants and dishes, participate in contests, and contribute content. Votes and rankings are intended to reflect genuine opinions. You agree not to manipulate rankings or contests through automated means, duplicate or fraudulent accounts, vote-buying, or other deceptive practices. Your use of the Service must also comply with our Community Guidelines. We may adjust, withhold, or reverse votes and results, and remove content or accounts, to protect the integrity of the platform.
You retain ownership of the content you submit (such as reviews, photos, and comments). By submitting content, you grant FoodRank a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content in connection with operating and promoting the Service. You represent that you have the rights to the content you submit and that it does not infringe the rights of others or violate any law. We may remove content that violates these Terms or our Community Guidelines.
Restaurant owners may claim a listing and subscribe to paid plans. Claiming a listing requires verification of your association with the business. Paid subscriptions, when offered, are billed through our payment processor, Stripe; FoodRank does not store your full payment card details. Fees, billing intervals, and plan features are described at the point of purchase. Unless stated otherwise or required by law, payments are non-refundable, and you may cancel a subscription to stop future renewals.
You agree not to: violate any law or the rights of others; submit false, misleading, defamatory, harassing, or unlawful content; attempt to gain unauthorized access to the Service, other accounts, or our systems; scrape, spam, or interfere with the normal operation of the Service; or manipulate votes, rankings, reviews, or contests.
The Service, including its software, design, logos, and trademarks, is owned by FoodRank and protected by intellectual property laws. Except for your own content and as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Rankings, contest results, and other content reflect user activity and are not guarantees of quality. We do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, FoodRank and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred U.S. dollars (USD 100).
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service and its users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute terms) will survive.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where prohibited by applicable law.
